Scott C. Rosentrater, Esquire

Scott Rosentrater is the owner of the Law Office of Scott C. Rosentrater, LLC, which was founded in 2012. Scott maintains a multidisciplinary general practice with the goal of offering sophisticated legal services to his clients. Over the last eleven years, Scott has helped many clients deal with complex civil litigation often dealing with serious personal and business implications. Scott has litigated a variety of complex claims before courts throughout Pennsylvania and is admitted to practice before the state and federal courts of Pennsylvania, and U.S. District Court for the East and Middle District of Pennsylvania and he has served as lead trial counsel in over 20 jury trials and more than 250 non-jury trials and arbitrations.

Scott has represented individuals, insurers and companies of all sizes in all facets of business and litigation matters. "Client service should be the focus of every lawyer's practice," says Scott. Scott's practice involves general litigation, which refers to litigation and all other aspects of law which may or may not be litigious in nature such as wills/estate planning, incorporating businesses, contract drafting, real-estate transactions, disputes with administrative bodies, and more. Scott's strong skills as a general practitioner enables him to take on any conflict and his practice is dedicated to areas of the law such as motor vehicle, arbitration and dispute resolution, products liability, premises liability, medical malpractice, and insurance law. The whole case, from beginning to end, Scott represents his clients at the start of the filing of initial pleadings through trial and all the way through the appellate process.

By way of background, upon graduating law school in 2001, Scott spent several years practicing as a trial attorney in a renowned Philadelphia plaintiff personal injury firm with an aggressive reputation for litigating claims.  Scott was primarily in charge of all the firm's social security cases and pending matters in cases outside of Philadelphia County. Scott excelled in advocating on behalf his clients in the areas of first- and third-party auto insurance claims, slip and fall accidents, as well as worker compensation and social security claims. Scott received maximum compensation for his injured and disabled clients by meticulously proving his clients' claims of medical bills, property damages, past and future wage losses, pain and suffering, embarrassment and humiliation and loss of life’s pleasures.

From 2004 through 2011, Scott worked as trial and appellate attorney practicing general casualty law at two widely known and esteemed Philadelphia law firms where he represented client ranging from corporations, both large and small, to individuals. From premises liability personal injury suits to negligent security matters, Scott provided dedicated and aggressive representation for his clients. As a defense lawyer, Scott became fully familiar with indemnity and additional insured issues that could result in the shifting of liability and exposure from one entity to another. Scott represented landlords, tenants, property owners, landscapers, management companies, utilities, governmental agencies and others in wrongful death, catastrophic personal injury, and property damage disputes.  

Scott handled a wide range of accidental and intentional fire claims, from those caused by arson, to natural gas explosions, and to negligent wiring and other electrical malfunctions since he is well-versed in addressing the unique questions that fire investigations and cases present, including area of origin and source of ignition, to preserving evidence, and to complex issues of proof. Scott was responsible for supervising property damage, wreckage, and product inspections, where he actively worked with clients. Scott worked with expert witnesses in orchestrating accident reconstructions and scientific testing to better assess his clients' exposure resulting from violations of building codes, city ordinances, trade customs, and professional standards, and that would eventually help judges and juries better understand scientific defenses at trials. Given his technical expertise, Scott drafted numerous complex Daubert motions that deal with the technical and legal intricacies of expert witnesses.  

From claims concerning the existence of coverage to primary and excess issues, Scott has handled a variety of insurance coverage disputes and has an extensive knowledge of the legal, financial and regulatory aspects of the insurance industry. Scott has also conducted internal and external investigations for insurance companies in complex civil disputes concerning allegations of insurance fraud and arson. Part of Scott's practice included assisting insurance companies in implementing legal protections and practical measures to minimize future litigation costs and remedies that apply to their respective policies. Scott gained a strong understanding of insurance policies and the various legal issues with his experience litigating numerous insurance bad faith cases. Scott was also involved in numerous extensive insurance claim investigations and conducted many high stakes examinations to identify and hold accountable individuals in the area of insurance fraud. Scott often accompanied cause and origin investigators in the field where there were suspected cases of fraudulent claims. 

Scott has extensive civil litigation experience relating to forged and falsified documents where Scott was lead counsel for defendants in a case where a plaintiff claimed he was prevented from attending medical school with full scholarship as a result of an alleged 'life-changing' personal injury. Scott obtained affidavits from the Dean of Admissions and a Doctor in their medical school disputing the validity of the acceptance letter of plaintiff into their program and of the letter of the scholarship award to plaintiff.

Scott's practice has also included representation of security guard companies in the many unique problems that arise in the industry of security, which are often dictated by the concerns of the business that the security guard companies were hired to protect. Scott's experience includes complex civil disputes defending clients accused of excessive use of force and inadequate and negligent security measures, among others.
Scott's business practice included counseling and representing companies in a wide variety of commercial disputes, including but not limited to matters involving contract disputes, civil fraud, civil RICO, breach of fiduciary duty, director and officer liability, and defense of consumer protection claims in a wide range of substantive commercial disputes over the construction and enforceability of complex commercial instruments and commercial agreements in all forms. Given the multiple challenges facing businesses in today's fast-paced, global economy, Scott provided his clients with the advice they needed to make well-informed decisions regarding their business plans and assisted in resolving disputes.  

Scott's background is in complex civil and commercial litigation, which has proven to be immensely useful in other areas of the practice of law where it is often necessary to deal with aggressive opposing parties. Scott has assisted with his condo association's Covenant Committee and has offered practical internal measures and he has trained and served as a mediator for the internal neighbor-mediation program. Scott serves as an Arbitrator for the Philadelphia Court of Common Pleas. He is also an active member of the Temple American Inn of Court and the Asian Pacific American Bar Association of Pennsylvania. Additionally, Scott also dedicates a portion of his practice and regularly represents clients on a pro bono basis through a nonprofit charitable organization, Philadelphia VIP ("VIP"), which promotes equal justice for the poor by providing civil legal services not otherwise available. Like VIP, Scott believes that everyone should have equal access to justice, regardless of income and that this is particularly important in this economy when even more people need our help. Scott hopes that his expertise in litigation helps his VIP clients maintain their income, stabilize their families, and remain in their homes. "Pro bono legal service is a fundamental part of who lawyers are, and, as a lawyer, we should also know how important it is to those we assist," says Scott.

Scott received his undergraduate and law degree from Temple University in Philadelphia, Pennsylvania. While at law school, he was awarded distinguished class performances in Trial Advocacy and in Civil Procedure -  the two classes which are considered the hallmarks of a great litigator. Scott is married to a pediatric dentist and they have one son who is currently in elementary school. Scott has two younger sisters, both of which are also lawyers in Philadelphia. When not working and volunteering, Scott spends his free time with his family.
